Andy Woltman and Stewart Ackerly recently spoke with the ABA International Law Section M&A Joint Venture Committee about commercial litigation finance. Andy and Stewart’s presentation provided an overview of commercial litigation finance, how it works, and why transactional lawyers and their clients should know about it and understand it. Not only should transactional lawyers and their clients be aware of litigation funding in case a dispute arises out of a transaction, but also so they can account for litigation funding in dispute resolution and fee-shifting provisions in transactional documents.
